Section 1363.07 was added, and section 1365.2 was repealed and added to the Civil Code with the enactment of Assembly Bill 1098 of 2005. (See Exhibit #1h) Assembly member Dave Jones introduced this measure on February 22, 2005 on behalf of the California Alliance of Retired Americans. (See Exhibits #1a; #6, document AP2-37; and #10b, page 1)
Assembly Bill 1098 was assigned to both the Assembly Committee on Judiciary, Assembly Committee on Housing and Community Development and the Senate Committee on Transportation and Housing where policy issues raised by the bill were considered. (See Exhibits #3, #5, and #8) Six amendments were made to Assembly Bill 1098. (See Exhibits #1b through #1g and #2) Subsequent to legislative approval, Governor Arnold Schwarzenegger signed the bill on October 3, 2005 and it was recorded by the Secretary of State on that day as Chapter 458 of the Statutes of 2005. (See Exhibit #1h)
The Office of Senate Floor Analyses in its Third Reading analysis of Assembly Bill 1098, as last amended on September 2, 2005, summarized the measure as follows:
This bill requires a common interest development association to make available all association records, as opposed to just accounting books and records and meeting minutes, to a member of the association, apply this provision to related community service organizations, and increase civil penalties for a violation of these provisions.
