SENATE BILL 1082 (ORTIZ – 1999)

Health and Safety Code sections 1771, 1771.5, 1771.9, 1779, and 1788 were amended, and section 1771.11 was added to the Health and Safety Code in 1999 following legislative approval of Senate Bill 1082.  (See Exhibit #1h)  Senator Deborah Ortiz introduced this measure on February 26, 1999 on behalf of the Continuing Care Residents Association.  (See Exhibits #1a and #12) 

Senate Bill 1082 was assigned to the Senate Committee on Health and Human Services and the Assembly Committee on Aging and Long Term Care where policy issues raised by the bill were considered.  (See Exhibits #3 and #8)  The fiscal ramifications of the bill were considered by the Senate Committee on Appropriations and the Assembly Committee on Appropriations.  (See Exhibits #5 and #10)  Six amendments were made to Senate Bill 1082.  (See Exhibit #1b through #1g)  Subsequent to legislative approval, Governor Gray Davis signed Senate Bill 1082 on October 10, 1999, and it was recorded by the Secretary of State on that date as Chapter 949 of the Statutes of 1999.  (See Exhibits #1h and #2)

The Office of Senate Floor Analyses’ Unfinished Business analysis summarized Senate Bill 1082, as last amended on September 3, 1999, as follows:

This bill provides residents of continuing care retirement communities (CCRCs) with access to financial information regarding the operation of CCRC and additional state oversight.
