SENATE BILL 280 (GRUNSKY – 1973)

Section 53069.85 was added to the Government Code in 1973 following legislative passage of Senate Bill 280.  (See Exhibit #1d)  Senator Donald L. Grunsky introduced this bill on February 22, 1973.  (See Exhibit #1a)  Senate Bill 280 was a single-issue bill adding section 53069.85 only.  (See Exhibits #1a through #1d)


 


While Senate Bill 280 was before the Legislature, the Senate and Assembly Committees on Local Government considered the policy issues raised by the bill.  (See Exhibits #3 and #5)  One amendment was made to Senate Bill 280 during consideration by the Senate.  (See Exhibits #1b and #2)  Following unanimous approval by both Houses of the Legislature, the enrolled version of Senate Bill 280 was signed by Governor Ronald Reagan on June 12, 1973 and recorded by the Secretary of State as Chapter 83 of the Statutes of 1973.  (See Exhibits #1c, #1d and #2)

SB 280 would resolve the above-mentioned quandary faced by local agencies in recovering damages resulting from the non-performance of construction contracts.
