ASSEMBLY BILL 181 (CAMPBELL – 1989)

As enacted in 1989, Assembly 181 amended sections of the Business and Professions Code, Education Code, Government Code, and Health and Safety Code, and it added sections to both the Education Code and Government Code all relating to school facilities funding.  (See Exhibit A #1i)  Assembly member Robert J. Campbell introduced this legislation on December 29, 1988.  (See Exhibit A #1a)  At this time, Assembly member Campbell served on the Joint Committee on School Facilities.  (See Exhibit #15, document PE-10)

Assembly Bill 181 was assigned to the Assembly Committee on Education and the Senate Committee on Education where policy issues raised by the bill were considered.  (See Exhibit A, #3 and #8)  The fiscal ramifications of the bill were considered by the Assembly Committee on Ways and Means and the Senate Committee on Appropriations.  (See Exhibit A, #2 and #5)  Seven amendments were made to Assembly Bill 181.  (See Exhibit A, #1b through #1h and #2)  Subsequent to legislative approval, Governor George Deukmejian signed the bill on October 1, 1989, and it was recorded by the Secretary of State on that date as Chapter 1209 of the Statutes of 1989.  (See Exhibit A, #1i and #2)

Assembly Bill 181 contained an urgency clause which caused the bill to go into immediate effect.  The reason for this urgency can be found in section 37 of Chapter 1209.

DIGEST:   This bill would make numerous changes to the Business and Professions Code, the Education Code, the Government Code, the Health and Safety Code, and the Public Resources Code relative to elementary and secondary school facility construction issues.  The bill clarifies the procedures for school boards and local governments for the levy of developer fees for school facilities.  It also clarifies many definitions and formulas in current law for school facilities.

Senate Floor Amendments of 9/13/89 primarily delete the enhanced provisions which would add costs to the construction, reconstruction, and remodeling of school facilities.
