ASSEMBLY BILL 1929 (BADER – 1988)

Assembly Bill 1929, as enacted, amended section 17718.5 of the Education Code, and amended sections 53080, 65995, added section 65995.1 and repealed and added section 65997 of the Government Code.  (See Exhibit #1f)  Assembly member Bader introduced Assembly Bill 1929 on March 5, 1987 relating to school facilities fees.  (See Exhibit #1a)

Assembly Bill 1929 was assigned to the Assembly Committee on Education and the Senate Committee on Education where policy issues raised by the bill were considered.  (See Exhibits #3 and #8)  The fiscal ramifications of the bill were considered by the Assembly Committee on Ways and Means and the Senate Committee on Appropriations.  (See Exhibits #2 and #5)  Three amendments were made to Assembly Bill 1929.  (See Exhibits #1b through #1d and #2)  When the Assembly refused to accept the Senate amendments, a Conference Committee was called.  (See Exhibit #2)  The purpose of a Conference Committee is to bring together six legislators, three from each House, in an attempt to reach a compromise on a bill’s language which is acceptable to both the Senate and the Assembly.

The Conference Committee on Assembly Bill 1929 made amendments to the bill in a conference report, which were accepted by the Legislature.  (See Exhibits #1e and #2)  Subsequent to legislative approval, Governor George Deukmejian signed the bill on March 14, 1987, and it was recorded by the Secretary of State on that day as Chapter 29 of the Statutes of 1987.  (See Exhibits #1f and #2)

Assembly Bill 1929 as last amended was summarized in the Conference Completed analysis prepared by the Office of Senate Floor Analyses as follows:

Conference Amendments of 3/3/88 delete the prior version of the bill, which made several changes in the laws governing state and local policies for financing the construction and reconstruction of local school facilities.

The bill now makes modifications to the school facilities bills of 1986 relating to developer fees used to finance the construction of school facilities.
