ASSEMBLY BILL 1575 (WARREN – 1974)

Public Resources Code section 21100 was amended, Division 15 of the Public Resources Code was added, and Part 3 of Division 13 of the Health and Safety Code was repealed in 1974 following legislative passage of Assembly Bill 1575, which enacted the Warren-Alquist State Energy Resources Conservation and Development Act.  (See Exhibit A, #1j)  The bill was introduced on April 25, 1973 by Assembly member Charles Warren.  (See Exhibit A, #1a)  It appears that Assembly Bill 1575 resulted from deliberations by the Assembly Subcommittee on Energy.  (See Exhibit A, #8, documents PE-10 and PE-13)

Assembly Bill 1575 was heard initially in the Assembly Committee on Governmental Administration but was withdrawn from that committee and referred to the Committee on Planning and Land Use.  (See Exhibit A, #2)  Thereafter it was heard in the Assembly by the Committee on Ways and Means and the Committee on Revenue and Taxation.  (Id.)  The principal policy committee appears to have been the Assembly Committee on Planning and Land Use.  (See Exhibit A, #3) 

In the Senate, Assembly Bill 1575 was heard in the Senate Committee on Public Utilities and Corporations and the Senate Committee on Finance.  (See Exhibit A, #2)  The principal policy committee was the Committee on Public Utilities and Corporations.  (See Exhibit A, #5) 

Assembly Bill 1575 was amended eight times, twice in the Assembly and six times in the Senate.  (See Exhibit A, #1b through #1i and #2)  Thereafter, Assembly Bill 1575 was approved by the Legislature on May 17, 1974, signed by Governor Ronald Reagan on May 21, 1974, and enacted on that date as Chapter 276 of the Statutes of 1974.  (See Exhibit A, #1j and #2)

The Legislative Analyst prepared an analysis of Assembly Bill 1575 as amended on April 29, 1974 that described this measure as follows:

    This bill creates the State Energy Resources Conservation and Development Commission in the Resources Agency.  In addition the bill amends the Environmental Quality Act of 1970.  This bill is to become effective on January 7, 1975.
