ASSEMBLY BILL 1256 (MANGERS – 1978)

Education Code section 1294 was amended, Education Code section 22723 was repealed, and section 44987 was added to the Education Code in 1978 following legislative approval of Assembly Bill 1256, which affected these three sections only.  (See Exhibit A, #1g)  This bill was introduced on March 31, 1977 by Assembly member Carmen Perino and related to the County Employees’ Retirement Law of 1937.  (See Exhibit A, #1a) 

In this early form of the bill, Assembly Bill 1256 was assigned to the Assembly Committee on Public Employment and Retirement, the Assembly Committee on Ways and Means, and the Assembly Committee on Revenue and Taxation. (See Exhibit A, #2, #3, and #4) 

When it reached the Senate, Assembly Bill 1256 was assigned to be heard by the Senate Committee on Public Employment and Retirement on January 31, 1978.  (See Exhibit A, #2)  The first hearing was cancelled by the author in mid-April.  (Id.)  On August 7, 1978, the subject matter of Assembly Bill 1256 changed to address public employees and leaves of absence.  (See Exhibit A, #1d)  One week later, Assembly member Dennis Mangers was substituted in as author of Assembly Bill 1256.  (See Exhibit A, #1e)  The Senate amendments of August 23, 1978 changed to subject matter to relate to school employees.  (See Exhibit A, #1f)

Thus, Assembly Bill 1256 was amended five times as it was considered by both Houses.  (See Exhibit A, #1b through #1f)  Subsequent to legislative approval, Governor Edmund G. Brown, Jr., signed the bill on September 26, 1978.  The Secretary of State recorded Assembly Bill 1256 on September 27, 1978 as Chapter 1169 of the Statutes of 1978.  (See Exhibit A, #1g and #2)

An Enrolled Bill Report prepared by State Teachers’ Retirement Board described Assembly Bill 1256 as follows:

The bill requires the governing board of a school district or a County Superintendent of Schools to grant to any certificated employee, upon request, a leave of absence without loss of compensation for the purpose of enabling such employee to serve as an elected officer of any statewide public employee organization or of any national organization with which such statewide organization is affiliated.
