SENATE BILL 710 (LAW – 1939)

As enacted Senate Bill 710 amended Insurance Code sections 1019, 1025, 1033, 1035, 1037, 1058, 1061, 1392, and 1393 and enacted Insurance Code section 1062.  (See Exhibit #1d)  Senator Edward H. Law introduced the measure on January 24, 1939 at the suggestion of the Department of Investment.  (See Exhibits #1 and #7) 

Senate Bill 710 was heard by the Senate and Assembly Committees on Insurance.  (See Exhibit #2)  Following two amendments, one in each House, Senate Bill 710 was approved by the Legislature. (See Exhibits #1b, #1c, and #2) Governor Culbert L. Olson signed the bill and it was recorded by the Secretary of State as Chapter 934 of the Statutes of 1939.  (See Exhibits #1d and #2)

The Summary Digest of Statutes Enacted provides the following description of Senate Bill 710:

Changes provisions re unliquidated claims, preference of claims, costs of administration and abandonment of property.  Deletes provision for summary hearing and determination of
 
pending actions against insurer.  Deletes provision re annual examination by Department of Finance of Books and accounts of Insurance Commissioner as conservator or liquidator.

Provides procedure for determining liability of members of insurer.
