ASSEMBLY BILL 165 (BEVERLY – 1970)

Insurance Code sections 675, et seq., were enacted in 1970 as a result of the passage of Assembly Bill 165.  (See Exhibit #1e)  Assembly member Robert Beverly, as lead author and Chair of the Assembly Committee on Finance and Insurance, introduced this legislation on January 14, 1970 at the request of the California Insurance Commissioner.  (See Exhibits #1a and #6, document PE‑4) 


 


Following its introduction, Assembly Bill 165 was heard by the Assembly Committee on Finance and Insurance and the Senate Committee on Insurance and Financial Institutions.  (See Exhibits #3 and #4)  The measure received the unanimous approval of both Houses, and Governor Ronald Reagan signed Assembly Bill 165 on July 6, 1970.  (See Exhibits #2 and #6, document PE‑1)  The bill became Chapter 313 of the Statutes of 1970.  (See Exhibits #1e and #2)


 


The Senate Committee on Insurance and Financial Institutions analysis of the bill as amended May 15, 1970 explained that Assembly Bill 165 was “part of Governor Reagan's Consumer Protection Program.”  (See Exhibit #4, page 2) 


 


A summary of Assembly Bill 165 was provided in an Enrolled Bill Memorandum to Governor dated June 30, 1970, which stated:


 


AB 165 creates restrictions on the contract right of insurers to cancel or refuse policies (other than automobile and workmen’s compensation) insuring risks or residents located in California. . . .
