Assembly Bill 1091 (Robinson – 1933)

Several former Political Code sections, relating to the qualification, licensing, and fees of insurance agents, brokers, and solicitors, were affected in 1933 with the passage of Assembly Bill 1091.  (See Exhibit #1e)  Assembly member C. Ray Robinson introduced the measure on January 25, 1933.  (See Exhibit #1a)

Assembly Bill 1091 was assigned to the Assembly and Senate Committees on Insurance where policy issues raised by the bill were considered.  (See Exhibit #2)  Three amendments were made to Assembly Bill 1091.  (See Exhibits #1b through #1d and #2)  Subsequent to legislative approval, Governor James Rolph, Jr. signed the bill on May 25, 1933, and it was enacted on that day as Chapter 545 of the Statutes of 1933.  (See Exhibits #1f and #2)

The Legislative Digest of 1933 summarized Assembly Bill 1091 as follows:

Deletes exemptions of title, mortgage, life insurance, fraternal benefit societies, or their solicitors or agents, reciprocal or interinsurance exchanges, or their attorneys, solicitors, agents, or employees, or surplus line brokers, from insurance agents, broker and solicitors qualification act.
    Raise solicitor’s annual fee from $1 to $2; prescribes additional fee of $1 for filing certificate of appointment of insurance agent; provides for expiration of certificate of convenience as well as license on July 1st.
    Provides that license of agents shall be forwarded to commissioner every July 1st by insurers.  Prohibits unlicensed clerical help from countersigning policies.
    Insurance Commissioner authorized to grant licenses to foreign agent as well as broker.  Raises foreign agent’s or broker’s license from same as resident agent or broker to $25; and authorizes commissioner to use discretion in exempting foreign agent or broker from requirement of qualification examination. Imposes $1 examination fee for taking qualification examination.
    Failure to apply for renewal of license within 30 days after every July 1st subjects agent or broker to penalty of twice fee prescribed in Sec. 605, Pol. C., for issuance of license.
