Assembly Bill 2929 was a single-section bill that amended now former Civil Code section 3369 only. (See Exhibit #1b) The word “unlawful” was added to Civil Code section 3369(3), the predecessor of current Business and Professions Code section 17200. (See Exhibits #1a and #1b) Assembly member Philip L. Soto introduced Assembly Bill 2929 on April 26, 1963. (See Exhibit #1a)
The bill was heard in the Assembly Committee on Governmental Efficiency and Economy and in the Senate Committee on Judiciary. (See Exhibit #2) The measure was passed by the Legislature relatively quickly and without amendment, being approved on June 20, 1963. (See Exhibits #1 and #2) Assembly Bill 2929 was signed by Governor Edmund G. Brown on July 13, 1963, and recorded as Chapter 1606 of the Statutes of 1963. (See Exhibits #1b and #2)
The Legislative Counsel analysis of Assembly Bill 2929 described the bill as follows:
Adds to the definition of the term “unfair competition” for purposes of granting specific or preventive relief, “unlawful” as well as unfair or fraudulent business practice and unfair, untrue or misleading advertising.
