As enacted Assembly Bill 3289 was a single section bill that only added section 23208 to the Vehicle Code. (See Exhibit #1e) This bill was introduced on February 27, 1990 by Assembly member Terry Friedman at the request of the Los Angeles District Attorney’s Office. (See Exhibits #1a and #15, document A-20)
Assembly Bill 3289 was assigned to the Assembly Committee on Public Safety and the Senate Committee on Judiciary where policy issues raised by the bill were considered. (See Exhibits #3 and #8) The fiscal ramifications of the bill were considered by the Assembly Committee on Ways and Means and the Senate Committee on Appropriations. (See Exhibits #2 and #5) Three amendments were made to Assembly Bill 3289 during the legislative process. (See Exhibits #1b through #1d and #2) Subsequent to legislative approval, Governor George Deukmejian signed the bill on August 29, 1990, and it was recorded by the Secretary of State as Chapter 568 of the Statutes of 1990. The Third Reading analysis prepared by the Office of Senate Floor Analyses provides the following digest of Assembly Bill 3289 as it was last amended on July 27, 1990:
DIGEST: This bill provides that an additional and consecutive sentence of 60 days be imposed upon any person who recklessly drives a vehicle over the speed limit, as specified, while driving under the influence of alcohol or drugs or both.
