Assembly Bill 2700 was introduced on January 25, 1990 by Assembly member Roybal-Allard. (See Exhibit A, #1a) The Assembly Committee on Judiciary analysis and background information indicates this bill is sponsored by the Family Equity Coalition, the contact for whom was Sheila Kuehl, of the Southern California Women's Law Center. (See Exhibit A, #3, page 3 and #4, document AP-259) The Senate Committee on Judiciary notes the sponsor to be the Senate Task Force on Family Equity. (See Exhibit A, #7, page 4) In the Senate Judiciary background information, the sponsor is identified as the Family Equity Task Force with the same contact information as the Coalition. (See Exhibit A, #8, document SP-31) We presume all these supposed sponsors are roughly the same entity.
The measure as enacted affected only former Civil Code sections 4600, 4600.1 and 4608. (See Exhibit A, #1d)
Assembly Bill 2700 was assigned to the Assembly Committee on Judiciary and the Senate Committee on Judiciary where policy issues raised by the bill were considered. (See Exhibit A, #3 and #7) Two amendments were made to Assembly Bill 2700. (See Exhibit A, #1b, #1c and #2) Subsequent to legislative approval, Governor George Deukmejian signed the bill on September 7, 1990, and it was recorded by the Secretary of State on September 10th as Chapter 610 of the Statutes of 1990. The Third Reading Analysis of the Office of Senate Floor Analyses for Assembly Bill 2700 as last amended April 17, 1990, provides this digest of its provisions:
This bill provides that the court consider the parent's history of abuse by one parent against the other parent when awarding custody and visitation.
This bill would further provide that a court consider the parent's acts of domestic violence when they are part of a demonstrated and continuing pattern of violence when awarding custody on an ex parte basis.
