SENATE BILL 200 (KELLEY – 1997)

As enacted, Senate Bill 200 added section 7073.8 to the Government Code, and affected various sections of the Revenue and Taxation Code, relating to economic development.  (See Exhibit A, #1g)  Senator David Kelly introduced Senate Bill 200 on January 27, 1997 on behalf of the City of Brawley.  (See Exhibit A, #1a and #3, page 2)

Senate Bill 200 was assigned to the Senate Committee on Revenue and Taxation, the Senate Committee on Governmental Organization, the Assembly Committee on Revenue and Taxation, and the Assembly Committee on International Trade and Development where policy issues raised by the bill were considered.  (See Exhibit A, #3, #5, #11 and #13)  The fiscal ramifications of the bill were considered by the Senate Committee on Appropriations and the Assembly Committee on Appropriations.  (See Exhibit A, #7 and #15)  Five amendments were made to Senate Bill 200.  (See Exhibit A, #1b through #1f)  Subsequent to legislative approval, Governor Pete Wilson signed Senate Bill 200 on October 1, 1997, and it was recorded by the Secretary of State on October 3, 1997 as Chapter 609 of the Statutes of 1997.  (See Exhibit A, #1g and #2)

The Unfinished Business analysis of the Office of Senate Floor Analyses provides this digest of the provisions of Senate Bill 200 as last amended on September 10, 1997:

DIGEST: This bill would require the Trade and Commerce Agency to designate up to two Manufacturing Enhancement Areas that meet the specified criteria and would provide a hiring credit to manufacturing businesses located in the designated areas. The bill provisions are applicable to Brawley or Calipatria.

Assembly Amendments:

1.  Incorporate language to prevent chaptering out problems, if this bill, SB 965 and AB 1040 are enacted.

2.  Require the Trade and Commerce Agency to perform an audit of the program.

3.  Name the proposed development regions as Manufacturing Enhancement Areas.

4.  Modify the criteria for designation and the criteria for credit qualifications.
