Former Civil Code sections 4100 and 4101 were amended in 1977 following legislative passage of Assembly Bill 607, which affected these two sections only. (See Exhibit #1c) Assembly member Bruce Nestande introduced the bill at the request of the County Clerks’ Association of California on February 23, 1977. (See Exhibits #1a; #4, document AP-1; and #8, page 1)
Assembly Bill 607 was assigned to the Assembly Committee on Judiciary and the Senate Committee on Judiciary where policy issues raised by the bill were considered. (See Exhibits #3 and #6) One amendment was made to Assembly Bill 607 during legislative consideration. (See Exhibits #1b and #2) Subsequent to legislative approval, Governor Edmund G. Brown, Jr., signed the bill on August 17, 1977, and it was recorded by the Secretary of State on August 18, 1977 as Chapter 339 of the Statutes of 1977. (See Exhibits #1c and #2)
The Third Reading analysis prepared by the Senate Republican Caucus contained the following digest of Assembly Bill 607 as it was last amended on May 23, 1977:
This bill relating to marriages specifies the following:
Marriage is a personal relationship arising out of a civil contract between a man and a woman.
Any unmarried male of the age of 18 years or upwards and any unmarried female of the age of 18 years or older, are capable of consenting and consummating marriage.
Makes related technical change in the provision relating to person under the age of 18.
