Assembly Bill 408 (Epple – 1992)

Numerous sections relating to traffic violations were affected with the passage of Assembly Bill 408 of 1992.  (See Exhibit #1l)  Assembly member Robert Epple introduced this measure on February 4, 1991on behalf of the California Public Parking Association.  (See Exhibits #1a; #8c, page 1; and #9, document SP-66)


Assembly Bill 408 was assigned to the Assembly Committee on Transportation and the Senate Committee on Judiciary where policy issues raised by the bill were considered.  (See Exhibits #3 and #8)  The fiscal ramifications of the bill were considered by the Assembly Committee on Ways and Means and the Senate Committee on Appropriations.  (See Exhibits #5 and #10)  Ten amendments were made to Assembly Bill 408.  (See Exhibits #1b through #1k and #2)  Subsequent to legislative approval, Governor Pete Wilson signed the bill on September 29, 1992, and it was recorded by the Secretary of State on September 30 as Chapter 1244 of the Statutes of 1992.  (See Exhibits #1l and #2)


The Office of Senate Floor Analyses’ Third Reading analysis of Assembly Bill 408 provided the following summary of the measure as last amended on August 18, 1992:

This bill provides that parking violations are decriminalized, to be resolved by payment of a civil penalty to the issuing jurisdiction and with an administrative adjudication process established to handle contested citations.
