As enacted, Senate Bill 330, a single-section bill, amended only former Code of Civil Procedure section 1365 relating to persons entitled to administer the estates of decedents. (See Exhibit #1b) This legislation was introduced on January 17, 1907 by Senator Wolfe at the request of the California Code Commission. (See Exhibits #1a and #2)
Senate Bill 330 was assigned to the Senate Committee on Judiciary and the Assembly Committee on Revision and Reform of Law where policy issues raised by the bill were considered. (See Exhibit #2) No amendments were made to Senate Bill 330 after its introduction. (Id.) Subsequent to legislative approval, Governor James Gillett signed Senate Bill 330 on March 18, 1907, and it was recorded by the Secretary of State on the same day as Chapter 296 of the Statutes of 1907. We found no surviving documentation on the consideration of Senate Bill 330 from either of the committees that heard this bill, its author, Senator Wolfe, nor the Governor. In an effort to seek information from those involved in the legislative process, trade associations or state agencies, boards or commissions, we culled through contemporary 1905 through 1908 state bar materials, law reviews, legislative journals, and other state records. We found and include excerpts from the Assembly Journal, Code Commissioner's Notes, and a Report of the Commissioners for the Revision and Reform of the Law from 1900. (See Exhibits #3 through #5)
