As enacted Assembly Bill 1251 added and amended various Water Code sections and added section 5803 to the Fish and Game Code relating to water quality. (See Exhibit #1e) Assembly member Carley V. Porter, along with other Assembly members and Senator Cologne, as coauthor, introduced the measure on March 16, 1970 at the request of the State Water Resources Control Board. (See Exhibits #1a and #5, document PE-2)
The measure was assigned to the Assembly Committee on Water and the Senate Committee on Water Resources where policy issues raised by the bill were considered. (See Exhibit #2) The Assembly Committee on Ways and Means and the Senate Committee on Finance examined its fiscal implications. (Id.) Assembly Bill 1251 was amended three times, twice in the Assembly and once in the Senate before it was approved by the Legislature. (See Exhibits #1b through #1d and #2) Governor Ronald Reagan signed the legislation on September 14, 1970, and the Secretary of State recorded it as Chapter 918 of the Statutes of 1970. The Legislative Analyst analysis of Assembly Bill 1251 described the bill as last amended on July 21, 1970 as follows:
This bill provides various technical and procedural amendments in the Porter-Cologne Water Quality Control Act. Most of the amendments clarify the provisions covering water reclamation. Any person proposing to reclaim water or use reclaimed water is to file a report with the appropriate regional board. The Attorney general at the request of the regional board is authorized to seek injunctive relief if the reports are not submitted or if the person reclaiming water or using reclaimed water is in violation of standards set by the board.
