ASSEMBLY BILL 128 (GOLDBERG – 2001)

Education Code sections 45113 and 88013 were amended with the passage of Assembly Bill 128 of 2001.  (See Exhibit A, #1h)  Assembly member Kevin Shelley introduced this measure on January 22, 2001, and was joined by Assembly member Jackie Goldberg as principal co-author on April 3, 2001.  (See Exhibit A, #1d)  The American Federation of State, County and Municipal Employees and the California School Employees Association sponsored this measure in its final form.  (See Exhibit A, #10b, page 1; and #12, document PE-2)

Assembly Bill 128 was assigned to the Assembly Committee on Education and the Senate Committee on Education where policy issues raised by the bill were considered.  (See Exhibit A, #3 and #8)  The fiscal ramification of the bill was considered by the Assembly Committee on Appropriations.  (See Exhibit A, #2 and #5)  Six amendments were made to Assembly Bill 128.  (See Exhibit A, #1b through #1g and #2)  Subsequent to legislative approval, Governor Gray Davis signed the bill on October 12, 2001, and it was recorded by the Secretary of State on October 13, 2001 as Chapter 839 of the Statutes of 2001.  (See Exhibit A, #1h and #2)

The Third Reading analysis by the Office of Senate Floor Analyses summarized Assembly Bill 128 as last amended on September 13, 2001, as follows:

This bill specifies that nothing prohibits school district and community colleges, that have not adopted a civil service merit system for its classified employees, to submit employee disciplinary cases to third party arbitration, except for peace officers.
