As enacted in 2001, Assembly Bill 139 proposed to amend sections 1240, 1241.5, 42127.6, and 42638 of the Education Code, relating to public school finance. (See Exhibit #1h) Assembly Bill 139 was introduced on January 24, 2001 by Assembly member Thomas Calderon to allocate funds to school districts and community college districts for electrical energy usage. (See Exhibit #1a) Assembly member Dean Florez subsequently replaced Assembly member Calderon as author of the bill on May 1, 2001. (See Exhibit #1b) At this time, the prior proposal was deleted from the bill, and a new proposal relating to fiscal duties of the County Superintendent of Schools was proposed in its place. (Id.)
Assembly Bill 139 was assigned to the Assembly Committees on Education and Utilities and Commerce and the Senate Committee on Education where policy issues raised by the bill were considered. (See Exhibits #2, #3 and #9) The fiscal ramifications of the bill were considered by the Assembly Committee on Appropriations and the Senate Committee on Appropriations. (See Exhibits #6 and #11) Six amendments were made to Assembly Bill 139. (See Exhibits #1b through #1g and #2) Subsequent to legislative approval, Governor Gray Davis signed the bill on October 8, 2001, and it was recorded by the Secretary of State on October 9, 2001 as Chapter 620 of the Statutes of 2001. The Third Reading analysis of the Office of Senate Floor Analyses provided the following synopsis of Assembly Bill 139 as last amended on August 27, 2001, stating:
This bill clarifies and expands the authority of County Superintendents of Schools in their oversight responsibilities relative to local school district financial matters.
