Senate Bill 2604 (Presley - 1988)

Senator Robert Presley introduced Senate Bill 2604 on February 19, 1988 at the request of the Office of the State Controller.  (See Exhibits #1a, #3, and #5)  Senate Bill 2604 was a single-section bill that proposed to amend Code of Civil Procedure section 36 only.  (See Exhibit #1c)

Senate Bill 2604 was assigned to the Senate and Assembly Committees on Judiciary where policy issues raised by the bill were considered.  (See Exhibits #3 and #6)  The bill was amended on only one occasion, in the Assembly on August 9, 1988.  (See Exhibits #1b and #2)  Subsequent to legislative approval, Senate Bill 2604 was signed by Governor George Deukmejian on September 23, 1988, and it was recorded by the Secretary of State on that date as Chapter 1237 of the Statutes of 1988.  (See Exhibits #1c and #2)

The Assembly Committee on Judiciary analysis of Senate Bill 2604 described the bill as last amended on August 9, 1988 as follows:

This bill adds to the list of civil cases given precedence by providing that a civil action for wrongful death or personal injury is entitled to a preference upon motion of a party who is under 14 years of age unless that party does not have a substantial interest in the case as a whole.  However, this new precedence shall be subordinate to the precedence granted a party 70 years of age.
