Senate Bill 972 (Lagomarsino-1967)

Labor Code section 204 was amended and section 204.1 was added to the Labor Code in 1967 following legislative passage of Senate Bill 972, which affected only these two sections.  (See Exhibit #1e)  Senator Robert Lagomarsino introduced Senate Bill 972 on April 10, 1967 on behalf of the Motor Car Dealers Association of Northern and Southern California.  (See Exhibits #1a and #4, document PE-2)   

The Assembly Committee on Labor and the Senate Committee on Industrial Relations considered the policy issues raised by the bill.  (See Exhibits #2 and #3)  Following three amendments, Senate Bill 972 was approved by both Houses of the Legislature, signed by Governor Ronald Reagan on August 4, 1967, and recorded by the Secretary of State as Chapter 1170, Statutes of 1967.  (See Exhibits #1b through #1e and #2)

According to the sponsor, the legislation was requested “for the purpose of bringing the California Labor Code into conformity with certain provisions of the (1966) Amended Federal Wage-Hour Law, which affected our industry February 1, 1967.”  (See Exhibit #4, document PE-9)

A description of Senate Bill 972 was provided in the Summary Digest of Statutes Enacted prepared by the Legislative Counsel as follows:

    Makes commission wages paid to any person employed by a licensed vehicle dealer due and payable once during each calendar month on a regular designated payday, rather than twice a month, unless there exists, a collective bargaining agreement which provides for the date on which wages shall be paid.
