SENATE BILL 1318 (BOATWRIGHT – 1982)

Senate Bill 1318 of 1982 was a single-section bill that proposed to amend Government Code section 1091 only.  (See Exhibit #1c)  Senate member Boatwright introduced the legislation, pertaining to conflicts of interest of public officers and employees, on January 7, 1982.  (See Exhibits #1a, and #10, document PE-4)

Senate Bill 1318 was assigned to the Senate Committee on Governmental Organization and the Assembly Committee on Governmental Organization where policy issues raised by the bill were considered.  (See Exhibits #3 and #8)  One amendment was made to Senate Bill 1318 during legislative consideration.  (See Exhibits #1b and #2)  Subsequent to legislative approval, Governor Edmund G. Brown Jr., signed Senate Bill 1318 on July 7, 1982, and it was recorded by the Secretary of State on July 8, 1982 as Chapter 451 of the Statutes of 1982.  (See Exhibits #1c and #2)

As introduced on January 7, 1982, Senate Bill 1318 proposed to expand the definition of “remote interest” for contracts by adding subdivision (b)(10) to Government Code section 1091, which read as follows:

(10) That of an engineer, geologist, or architect employed by a consulting engineering or architectural firm.  This paragraph applies to a person who is an employee only and not to an officer or director of a consulting firm.
