ASSEMBLY BILL 1315 (PORTER – 1971)

As enacted, Assembly Bill 1315 amended Water Code sections 183, 1060, 13142, 13147, 13160, 13245, 13247, 13301, 13304, 13320, and 13360 and added sections 13160.1 and 13170 to the Water Code. (See Exhibit #1f) The bill was introduced by Assembly member Carley V. Porter as lead author on March 29, 1971, who served as chair of the Assembly Committee on Water as this time. (See Exhibits #1a and #5, document PE-1) The sponsor of the bill was the State Water Resources Control Board. (See Exhibit #5, document PE-1)
While in the Assembly, the bill was heard by the Assembly Committee on Water and the Assembly Committee on Ways and Means. (See Exhibit #2) In the Senate, the measure was heard in the Senate Committee on Water Resources and the Senate Committee on Finance. (See Exhibits #2 and #3) Assembly Bill 1315 was amended four times during the legislative process and then was approved by the Legislature on October 14, 1971. (See Exhibits #1b through #1e and #2) Governor Ronald Reagan signed the bill on October 29, 1971, and it was recorded on that date as Chapter 1288 of the Statutes of 1971. (See Exhibits #1f and #2)
It appears that Assembly Bill 1315 was seen as a technical and procedural bill to clean‑up the Porter‑Cologne Water Quality Act enacted in 1969. (See Exhibit #3, page 1) Thus, perhaps because of its technical nature, little documentation has survived regarding legislative consideration of this bill. However, Assembly Bill 1315 proposed some substantive changes. (See Exhibit #1a through #1f)
The Resources Agency of the Water Resources Control Board prepared an
analysis of Assembly Bill 1315 that listed each section that was substantively amended by Assembly Bill 1315, which you may find useful to review. (See Exhibit #5, document PE‑2)
In his letter to the Governor, Assembly member Porter described the “two substantive changes” made by Assembly Bill 1315 as follows:
The first change authorizes the State Water Resources Control Board to establish a fee schedule to recover any costs which the state might incur as a result of providing certifications required by federal law. The second change provides an exemption from existing provisions of the Porter-Cologne Act which preclude the State Water Resources Control Board and the regional water quality control boards from specifying the manner of compliance with waste discharge requirements. This exemption applies only to solid waste disposal and is essential to permit the state and regional boards to more effectively deal with water quality problems caused by the disposal of solid waste materials.
