Senate Bill 66 (Grunsky – 1972)

Insurance Code section 11580.2 was amended in 1972 following legislative approval of Senate Bill 66, a single-section bill that affected only section 11580.2.  (See Exhibit #1f)  This bill was introduced by Senator Donald Grunsky on January 17, 1972.  (See Exhibit #1a)  It appears that Senator Grunsky may have introduced this legislation at the request of State Farm Insurance Companies and Mercury Casualty Company.  (See Exhibit #6, document PE-5)

Senate Bill 66 was introduced on January 17, 1972 and was heard first in the Senate Committee on Insurance and Financial Institutions.  (See Exhibits #1a and #3)  After approval in the Senate Committee on Insurance and Financial Institutions, the bill was heard in the Assembly Committee on Finance and Insurance.  (See Exhibit #5)  Since Senate Bill 66 was amended by the Assembly, it was sent back to the Senate for approval of the Assembly’s amendments.  The Senate approved and passed the bill on August 2, 1972.  (See Exhibit #2)  Senate Bill 66 was signed by Governor Ronald Reagan on August 16, 1972 and chaptered by the Secretary of State as Chapter 952 of the Statutes of 1972.  (See Exhibits #1f and #2)

The Senate Committee on Insurance and Financial Institutions analysis of the bill as amended June 29, 1972 provided the following background discussion:

BACKGROUND:  With respect to an accident involving an uninsured motorist and an employee covered by workmen’s compensation insurance, present law does not establish the fiscal relationship between 1) the automobile insurance carrier and 2) the workmen’s compensation insurer.
