ASSEMBLY BILL 1942 (DAVIS – 1983)

CHAPTER 868, STATUTES OF 1983

Sections 4217.10, et seq., were added to the Government Code, Public Utilities Code section 2821 was amended, and section 228.5 was added to the Public Utilities Code in 1983 following legislative passage of Assembly Bill 1942.  (See Exhibit #1)  Assembly member Gray Davis introduced this measure on March 4, 1983.  (See Exhibit #1a)

Assembly Bill 1942 was assigned to the Assembly Committee on Natural Resources where policy issues raised by the bill were considered.  (See Exhibit #3)  The Assembly amended the bill on May 16 and May 25, 1983.  (See Exhibit #1b and #1c)  Assembly Bill 1942 was approved by the Assembly and forwarded to the Senate on June 2, 1983.  (See Exhibit #2)

While in the Senate, the Committee on Energy and Public Utilities considered the policy issues raised by the bill.  (See Exhibit #4)  Subsequent to approval by that Committee, the measure was assigned to the Senate Committee on Finance which examined its fiscal implications.  (See Exhibit #2)  Three amendments were made to Assembly Bill 1942 by the Senate, on July 8, July 19, and August 17, 1983.  (See Exhibit #1d through #1f)  The Senate thereafter approved the bill and returned it to the Assembly.  (See Exhibit #2)

The Assembly approved the Senate amendments and forwarded Assembly Bill 1942 to the Governor on September 7, 1983.  Governor George Deukmejian signed the bill on September 15, 1983 as Chapter 868, Statutes of 1983.  (See Exhibit #1g and #2)

The Senate Republican Caucus Third Reading analysis of Assembly Bill 1942 described this bill as last amended as follows:

This bill authorizes local public agencies (defined as cities, counties, school districts, etc.) to enter into cooperative arrangements for the purpose of generating energy at publicly owned facilities.
