Civil Code section 3260 was added in 1990 following legislative approval of Senate Bill 2515, which affected only this section. (See Exhibit A, #1g) Senator Robert Presley introduced Senate Bill 2515 on March 1, 1990 on behalf of the Concrete Contractors Association of California. (See Exhibit A, #1a and #3, page 1)
Senate Bill 2515 was assigned to the Senate Committee on Judiciary where policy issues raised by the bill were considered. (See Exhibit A, #2 and #3) The Senate amended the bill on May 7, May 22, and June 11, 1990. (See Exhibit A, #1b through #1d and #2) Senate Bill 2515 was approved by the Senate and forwarded to the Assembly on June 13, 1990. (See Exhibit A, #2)
While in the Assembly, the Assembly Committee on Governmental Efficiency and Consumer Protection considered the policy issues raised by the bill. (See Exhibit A, #2 and #7) Two amendments were made to Senate Bill 2515 by the Assembly, on August 6 and 14, 1990. (See Exhibit A, #1e, #1f, and #2) The Assembly thereafter approved the bill and returned it to the Senate. (See Exhibit A, #2) Shortly thereafter, the Senate approved the Assembly amendments and Senate Bill 2515 was forwarded to the Governor on September 7, 1990. Governor George Deukmejian signed the bill on September 29, 1990, and it was recorded by the Secretary of State the following day as Chapter 1536 of the Statutes of 1990. (See Exhibit A, #1g and #2)
The Unfinished Business analysis of Senate Bill 2515 as last amended on August 14, 1990 that was prepared by the Office of Senate Floor Analyses provided the following description of Senate Bill 2515:
. . . This bill would establish time frames for the payment of retention funds withheld by the owner from the original contractor or withheld by the general contractor from the subcontractor, as specified.
