Business and Professions Code sections 13300 and 13352 and Civil Code section 7100 were amended with the passage of Assembly Bill 2285 of 2006. (See Exhibits #1a through #1d) The Committee on Business and Professions introduced this measure on behalf of the California Retailers Association February 22, 2006. (See Exhibits #1a; #3; and #7, document SP-25)
Assembly Bill 2285 was assigned to the Assembly Committee on Business and Professions and the Senate Committee on Business, Professions and Economic Development where policy issues raised by the bill were considered. (See Exhibits #3 and #6) The fiscal ramifications of the bill were considered by both the Assembly and Senate Committees on Appropriations. (See Exhibits #5 and #2) Two amendments were made to Assembly Bill 2285. (See Exhibits #1b, #1c, and #2) Subsequent to legislative approval, Governor Arnold Schwarzenegger signed the bill on September 28, 2006 and it was recorded by the Secretary of State on that day as Chapter 566 of the Statutes of 2006. (See Exhibit #1d)
The Office of Senate Floor Analyses’ Third Reading analysis of Assembly Bill 2285 as last amended on June 19, 2006, summarized the measure as follows:
This bill makes changes to the list of items required to be displayed for consumers by automatic checkout systems. The bill also recasts the term “automatic checkout” to refer to the term “point-of-sale” and modifies the definition of “point-of-sale system.”
