Assembly Bill 488 (Parra – 2004)

Section 290.46 only was added to the Penal Code in 2004 following legislative approval of Assembly Bill 488, a single-section bill.  (See Exhibit A, #1i)  This bill was introduced on February 14, 2003, by Assembly member Nicole Parra at the request of the Attorney General’s Office.  (See Exhibit A, #1a and #4, document AP-1) 

Assembly Bill 488 was assigned to the Assembly Committee on Public Safety and the Senate Committee on Public Safety where policy issues raised by the bill were considered.  (See Exhibit A, #3 and #7)  The fiscal ramifications of the bill were considered by the Assembly Committee on Appropriations and the Senate Committee on Appropriations.  (See Exhibit A, #5 and #9)  Seven amendments were made, four in the Assembly and three in the Senate, to Assembly Bill 488.  (See Exhibit A, #1b through #1h and #2)  Subsequent to legislative approval, Governor Arnold Schwarzenegger signed the bill on September 24, 2004, and it was recorded by the Secretary of State as Chapter 745 of the Statutes of 2004.  (See Exhibit A, #1i and #2)

Assembly Bill 488 contained an urgency clause which caused the bill to go into immediate effect. (See Exhibit #1i, pages 7 and 8) The reason for this urgency can be found in section 5 of Chapter 745 wherein it states:

In order to ensure that members of the public have adequate information about the identities and location of sex offenders who may put them and their families at risk, it is necessary that this act take effect immediately.

The Office of Senate Floor Analyses produced a Third Reading analysis of Assembly Bill 488 as last amended on August 18, 2004 that described this bill as follows:

DIGEST:  This bill requires the State Department of Justice (DOJ) to establish an Internet site disclosing information pertaining to registered sex offenders beginning on or before July 1, 2005, as specified.
