Assembly Bill 3184 was introduced on March 10, 1980 by Assembly member Frank Vicencia for the Association of California Life Insurance Companies. (See Exhibits #1a; #3, page 2; and #4, document AP-1) The measure amended Insurance Code sections 1673, 1704, and 1707, relating to insurance agents. (See Exhibits #1a through #1d)
Assembly Bill 3184 was heard in the Assembly Committee on Finance, Insurance and Commerce. (See Exhibits #2 and #3) In the Senate the measure was before the Senate Committee on Insurance and Financial Institutions. (See Exhibits #2 and #5) Assembly Bill 3184 was amended twice while under legislative consideration and was heard “on consent” on the floor of both Houses, meaning it faced no opposition. (See Exhibits #1b, #1c, and #2) The measure was approved by Governor Edmund G. Brown, Jr., on July 8, 1980 and chaptered by the Secretary of State as Chapter 360, Statutes of 1980 on July 9, 1980. The Third Reading Analysis prepared by the Senate Republican Caucus provides this digest of Assembly Bill 3184 as last amended on June 17, 1980:
This bill provides that the authority to transact insurance given to an agent or to an applicant upon licensing by an insurer or an insurance agent or broker, as the case may be, by appointment is to be effective as of the date the notice of appointment is signed.
Such authority to transact is to apply to transactions occurring after that date and for the purpose of determining the insurer’s or insurance agent’s or broker’s liability for acts of the appointed licensee.
Requires that notices of appointment or notices of termination of appointment of agents or licensees to transact insurance be filed with the Insurance Commissioner within 10 days of appointment or termination.
