SENATE BILL 37 (KELLEY – 1995)

As enacted, Senate Bill 37 was a single section bill, only proposing amendments to Health and Safety Code section 43013.  (See Exhibit A, #1i)  The bill, introduced on December 14, 1994 by Senator Kelley, was sponsored by the California Independent Oil Marketers Association (CIOMA) and Western States Petroleum Association (WSPA).   (See Exhibit A, #1a, #9, document AP1-11 and #17, document PE-4)

Senate Bill 37 was assigned to the Senate Committee on Transportation and the Assembly Committee’s on Transportation and Natural Resources where policy issues raised by the bill were considered.  (See Exhibit A, #3, #8 and #10)  The fiscal ramifications of the bill were considered by the Senate Committee on Appropriations and the Assembly Committee on Appropriations.  (See Exhibit A, #4 and #12)  Seven amendments were made to Senate Bill 37.  (See Exhibit A, #1b through #1h and #2)  Subsequent to legislative approval, Governor Pete Wilson signed Senate Bill 37 on October 14, 1995, and it was recorded by the Secretary of State on October 16, 1995 as Chapter 930 of the Statutes of 1994.  (See Exhibits #1i and #2)

Addressing the content of the bill as last amended, August 29, 1995, the Unfinished Business Analysis of the Office of Senate Floor Analyses stated:

This bill requires the State Air Resources Board to consult with significantly impacted entities and makes determinations relative to motor vehicle fuels. 

Assembly Amendments:

1.    Make a clarifying addition as to what is to be included in the economic analyses.
2.    Added clarifying language if a conflict arises as to what information is required to be included in the analysis.
3.    Assembly Amendments also added and then deleted new language.
