Historical Trace of Civil Code section 3346

Some bill research does not include the Governor's file because at the time we researched the bill, the sitting Governor had not released his chaptered bill file. If the Governor's file is not included with this particular research, please contact our office (1-530-666-1917 or quote@legintent.com) and we will be happy to provide this file at no charge if it is available. Please Note: Governor files did not exist prior to 1943.

Civil Code section 3346.  Our review of the annotated history of this section in 2009 reveals the following legislative history (every “c.” below represents a separate legislative bill):

Prior History: Former § 3346, enacted in 1872 codification of Civil Code and derived from Field’s Draft of the New York Civil Code, § 1871
Current: re-enacted in 1957, c. 2346; no subsequent amendments thus far

It appears that the first half of current subdivision (a) language can be traced to the 1872 codification and the rest of the statutory language can be traced to the 1957 re-enactment.

Because we charge a fixed fee for each bill ordered for legislative history research, you will be able to minimize your research fees by focusing on specific language within the statute. You can review the above list at your local law library to determine which bill brought in your language or you can hire our firm to trace your language for you.  Contact us if you have any questions about traces, fees quotes, and legislative history and intent research.
