ASSEMBLY BILL 1809 (COMMITTEE ON BUDGET – 2006)

As Assembly Bill 1809 was enacted into law it amended, added, and repealed section 13305 of the Government Code, amended section 12975.9 of the Insurance Code, and amended section 6248, 7204.3, 7273, and 17052.2 of the Revenue and Taxation Code relating to various taxes. (See Exhibit #1c) This legislation is a spot bill as introduced on January 10, 2006 by the Committee on Budget. (See Exhibits #1a and #3c) Legislative Counsel explains “This bill would express the intent of the Legislature to enact statutory changes relating to the Budget Act of 2006." (See Exhibit #1a) The changes were amended into the bill in the first amended version of the bill on June 27, 2006. (See Exhibit #1b)
Assembly Bill 1809 was assigned to the Assembly Committee on Budget and the where policy issues raised by the bill were considered. (See Exhibit #2) One amendment was made to Assembly Bill 1809. (See Exhibits #1b and #2) Subsequent to legislative approval, Governor Arnold Schwarzenegger signed the bill on June 30, 2006 and it was recorded by the Secretary of State on that day as Chapter 49 of the Statutes of 2006. (See Exhibit #1c)
Assembly Bill 1809 contained an urgency clause which caused the bill to go into immediate effect. The reason for this urgency can be found in uncodified section 9 of Chapter 49.

This bill makes a number of revenue and taxation related changes necessary to implement the Budget Act of 2006.
