As enacted, Assembly Bill 1843 amended various sections of the Revenue and Taxation Code, relating to bank and corporations taxes. (See Exhibit #1b) Assembly Bill 1843 was introduced by Assembly member Dick Ackerman on February 7, 2000. (See Exhibit #1a)
Assembly Bill 1843 was assigned to the Assembly Committee on Revenue and Taxation and the Senate Committee on Revenue and Taxation where policy issues raised by the bill were considered. (See Exhibits #3 and #5) No amendments were made to Assembly Bill 1843. (See Exhibit #2) Subsequent to legislative approval, Governor Gray Davis signed the bill on September 28, 2000, and it was recorded by the Secretary of State on September 29th as Chapter 862 of the Statutes of 2000. (See Exhibits #1b and #2)
Assembly Bill 1843 spanned 400 pages and affected about 226 sections of the Revenue and Taxation Code. (See Exhibit #1b) This bill was enacted as introduced. (See Exhibits #1a, #1b and #2) The last section of the bill provided an uncodified statement of intent, which we quote in part as follows:
SEC 227. (a) In enacting the amendments made by this act, the Legislature declares that the sole purpose of these amendments is to simplify the Bank and Corporation Tax Law by changing its terminology so that “income year” and “taxable year” have the same meaning for calendar and fiscal years beginning on or after January 1, 2000.
