ASSEMBLY BILL 1624 (BADER – 1985)

Government Code section 66452.6 was amended in 1985 following legislative passage of Assembly Bill 1624, which affected this section only.  (See Exhibit #1e)  This bill was introduced by Assembly member Charles Bader on March 6, 1985 on behalf of the California Building Industry Association.  (See Exhibits #1a; #3b, page 2; and #4, document AP-1) 

Assembly Bill 1624 was heard in the Assembly by the Committee on Local Government and the Committee on Ways and Means.  (See Exhibits #3 and #5)  In the Senate, the bill was considered in the Committee on Housing and Urban Affairs and the Committee on Appropriations.  (See Exhibits #2 and #8)  Following three amendments, two in the Assembly and one in the Senate, Assembly Bill 1624 was approved by the Legislature on September 4, 1985, signed by Governor George Deukmejian and recorded by the Secretary of State as Chapter 852 of the Statutes of 1985.  (See Exhibits #1b through #1e and #2)

The Legislative Counsel’s Rule 26.5 analysis of Assembly Bill 1624 summarized the bill as last amended stating:

    AB 1624, as it passed the Assembly, prescribed an alternative expiration date for tentative subdivision maps if the subdivider, as a condition to approval of the map, is required to make or improve public improvements of $100,000 or more outside the subdivision.  The bill also permitted the expiration of a tentative map which is subject to a development agreement to be extended for a period provided for in the agreement.

    The Senate amendments incorporate additional changes, proposed by AB 2488, to be operative if AB 2488 and this bill are both chaptered and this bill is chaptered last.
