As enacted Senate Bill 2396 amended section 5422 of and added sections 54226, 54227, 54320, and 54230.5 to the Government Code. (See Exhibit #1f) Senate Bill Senate Bill 2396 was introduced by Senator Peter H. Behr on May 7, 1974 at the request of the Marin County Board of Supervisors. (See Exhibits #1a, #3, and #6)
Senate Bill 2396 was assigned to the Senate Committee on Governmental Organization and the Assembly Committee on Government Administration where policy issues raised by the bill were considered. (See Exhibits #3 and #7) The fiscal ramifications of the bill were considered by the Senate Committee on Finance. (See Exhibit #2) Four amendments were made to Senate Bill 2396 during the legislative process. (See Exhibits #1b through #1e and #2) Subsequent to legislative approval, Governor Ronald Reagan signed Senate Bill 2396 on September 26, 1974, and it was recorded by the Secretary of State on that date as Chapter 1339 of the Statutes of 1974. The Enrolled Bill Memorandum to Governor provides the following digest of Senate Bill 2396:
Requires state and local agencies disposing of surplus real property to notify any housing authority in the county where the property is located, in writing, of its intent to dispose of the property, and to offer to sell the property to such authority or authorities at fair market value. The changes made by this bill become effective January 1, 1975.
