Penal Code section 641.3, relating to commercial bribery, was added in 1989 following legislative passage of Senate Bill 569, which affected this section only. (See Exhibit A, #1e) Senator Quentin L. Kopp introduced the measure on February 22, 1989. (See Exhibit A, #1a)
The measure was heard by the Senate Committee on Judiciary and the Assembly Committee on Public Safety where policy issues raised by the bill were considered. (See Exhibit A, #3 and #8) The Senate Committee on Appropriations and the Assembly Committee on Ways and Means examined its fiscal implications. (See Exhibit A, #2 and #10) Subsequent to three amendments, one in the Senate and two in the Assembly, both Houses of the Legislature approved the bill. (See Exhibit A, #1b through #1d and #2) Senate Bill 569 was signed by Governor George Deukmejian on September 6th, and was recorded by the Secretary of State on September 7th as Chapter 308 of the Statutes of 1989. Senate Bill 569 as amended on June 22, 1989 was described as follows in the Unfinished Business analysis of the Office of Senate Floor Analyses:
DIGEST: The bill would create a new crime of commercial bribery.
