ASSEMBLY BILL 1916 (STIRLING – 1986)

As enacted Assembly Bill 1916 amended section 995.3 of, added and repealed Article 4.5 (commencing with section 53296) of and repealed and added sections 10548 and 19683 of the Government Code relating to public employees.  (See Exhibit #1i)  Assembly member Larry Stirling introduced Assembly Bill 1916 after he “witnessed a case of ‘whistleblower’ harassment in San Diego.”  (See Exhibits #1a and #16, document PE-2)  Please note that as the bill was introduced on March 7, 1985 it was a spot bill and it was not until the August 20, 1985 amendments that the substantive provisions were added to the bill.  (See Exhibits #1a and #1b)

Assembly Bill 1916 was assigned to and heard by the Assembly Committee on Public Safety.  (See Exhibit #3)  This committee made amendments to the bill and then re-referred it to the Assembly Committee on Public Employees and Retirement and the Assembly Committee on Ways and Means.  (See Exhibits #4 and #5)  On the Senate side, the measure was before the Senate Committee on Public Employment and Retirement and the Senate Committee on Appropriations.  (See Exhibits #2 and #7)  Seven amendments were made to Assembly Bill 1916.  (See Exhibits #1b through #1h and #2)  Subsequent to legislative approval, Assembly Bill 1916 was signed by Governor George Deukmejian on July 15th, and was recorded by the Secretary of State on July 16th as Chapter 353 of the Statutes of 1986.  (See Exhibits #1i and #2) 

Providing a digest of the bill as last amended on June 16, 1986, the Third Reading Analysis of the Office of Senate Floor Analyses stated:

DIGEST:  The bill establishes protections from reprisal for state and local government employees who become informants by providing for civil and criminal penalties against managers and supervisors.  Provides similar protections to applicants for state and local jobs.
