SENATE BILL 94 (SONG – 1970)

As enacted Senate Bill 94 amended section 14002 of the Agricultural Code and amended and added various Government Code sections relating to the liability of public entities and public employees.  (See Exhibit #1h) Senate Bill 94 was introduced by Senator Alfred H. Song on January 12, 1970 on behalf of the California Law Revision Commission [hereinafter referred to as “the Commission” or “the CLRC”].  (See Exhibits #1a and #4, document SP-1)

While before the Legislature, the measure was heard in the Senate Committee on Judiciary and the Assembly Committee on Judiciary.  (See Exhibits #3 and #6)  This bill was amended six times, five times by the Senate and once by the Assembly, as it was considered by the Legislature.  (See Exhibits #1b through #1g and #2)  Senate Bill 94 was approved by the Legislature on August 21, 1970, signed by Governor Ronald Reagan on September 15, 1970, and enacted as Chapter 1099 of the Statutes of 1970.  (See Exhibits #1h and #2)

The analysis of the bill that was prepared by the Senate Committee on Judiciary summarized this measure as follows:

SB 94 is a comprehensive revision of the Government Liability Act, relating to nuisance, entry re condemnation, prisoners, mental patients, ultra-hazardous activities and pesticides.
