Assembly Bill 544 (Isenberg – 1991)

Business and Professions Code section 6140.10, Education Code section 89012, numerous Government, Vehicle, and Penal Code sections, and Revenue and Taxation Code section 97.35 were affected in 1991 following the passage of Assembly Bill 544.  (See Exhibit #1e)  Assembly member Bruce Bronzan introduced the measure on February 14, 1991, but was replaced as the author on May 24, 1991, by Assembly member Isenberg.  (See Exhibits #1a and #1b)

 

Assembly Bill 544 was assigned to the Assembly Committee on Judiciary and the Senate Committee on Judiciary where policy issues raised by the bill were considered.  (See Exhibits #3 and #6)  The Senate amended Assembly Bill 544 once during the legislative process.  (See Exhibits #1b and #2)  On May 30, 1991, the Assembly refused to accept the Senate amendments and thus the bill was sent to a Conference Committee.  (See Exhibit #2) The purpose of a Conference Committee is to bring together six legislators, three from each House, in an attempt to reach a compromise on a bill’s language which is acceptable to both the Senate and the Assembly.

 

The Conference Committee on Assembly Bill 544 made amendments to the bill in a conference report on June 27, 1991 and the second conference report on July 2, 1991, which were accepted by the Legislature. (See Exhibits #1c, #1d, and #2) Subsequent to legislative approval, Governor Pete Wilson signed the bill on July 27, 1991 and it was recorded by the Secretary of State on July 29, 1991on as Chapter 189 of the Statutes of 1991.  (See Exhibits #1e and #2)

 

The Conference Completed analysis by the Office of Senate Floor Analyses summarized Assembly Bill 544 as last amended in Conference on July 2, 1991, stating:

 

This bill as amended in Conference Committee (1) requires the State Bar to transfer from its treasury, on or before 1/1/91, to the General Fund the amount of $200,000 for operation and maintenance of the California State Law Library; (2) revises and recast various provisions of AB 1297 the Trial Court Realignment and Efficiency Act of 1991; and (3) revises various provisions of SB 855, which establishes a State Courthouse Construction Fund, relative to the penalties for county purposes, to be operative 1/1/92.
