Assembly Bill 385 (Hannigan – 1981)

As enacted in 1981, Assembly Bill 385 affected numerous sections of the Public Resources Code, relating to the California coastal zone.  (See Exhibit #1h)  Assembly Bill 385 was introduced by Assembly member Thomas Hannigan on February 2, 1981 on behalf of the Coastal Commission.  (See Exhibits #1a and #15, document PE-1)  At this time, Assembly member Hannigan served as chair of the Assembly Committee on Energy and Natural Resources.  (See Exhibit #3a, page 1)

Assembly Bill 385 was assigned to the Assembly Committee on Energy and Natural Resources and the Senate Committee on Natural Resources and Wildlife where policy issues raised by the bill were considered.  (See Exhibits #3 and #8)  Six amendments were made to the bill.  (See Exhibits #1b through #1g)  Subsequent to legislative approval, the bill was signed by Governor Edmund G. Brown, Jr., on October 1, 1981 and chaptered by the Secretary of State on October 2, 1981 as Chapter 1173 of the Statutes of 1981.  (See Exhibits #1h and #2)

The Enrolled Bill Memorandum to the Governor from his staff provided the following summary of Assembly Bill 385 as last amended:

This measure transfer [sic] the coastal development permitting authority from the Coastal Commission to local governments for proposed developments within the coastal zone.  Provides other amendments to the California Coastal Act of 1976 as specified to clarify the State Commission’s responsibilities after the expiration of the regional commissions.”
