SENATE BILL 528 (CARRELL – 1967)

Senate Bill 528 was introduced on March 6, 1967 by Senator Tom Carrell. (See Exhibit A, #1a) Senator Carrell, a businessman from San Fernando, seems to have carried this bill on his own initiative, perhaps as a member of the Senate Committee on Transportation. (See Exhibit A, #3 generally – there is no reference to a legislative sponsor, and #8) Senate Bill 528 was a single-section bill adding only section 28050 to the Vehicle Code. (See Exhibit A, #1g)
Senate Bill 528 was heard in the Senate Committee on Transportation and the Assembly Committee on Criminal Procedure. (See Exhibit A, #2) The bill was amended five times prior to legislative passage. (See Exhibit A, #1b through #1f) On August 14, 1967 it was approved by Governor Ronald Reagan and enacted by the Secretary of State as Chapter 1109, Statutes of 1967. (See Exhibit A, #2)
Unfortunately neither of the legislative committees, nor author Tom Carrell have left files surviving or publicly available on the consideration of Senate Bill 528. The file of Governor Reagan then becomes primary evidence of the legislative history of the bill, and presumably, those submitting information on the bill were making the same representations to the Legislature.
The Legislative Counsel prepared a Summary Digest of Chapter 1109 which provided:
Makes it a misdemeanor for any person to advertise for sale, to sell, to use, or to install a device on any part of a motor vehicle or on an odometer in a motor vehicle which causes the odometer to register any mileage other than the true mileage driven. Specifies what constitutes true mileage driven.
