Insurance Code sections 1712.5, 1714, and 1731 were amended, former Insurance Code sections 1704, 1705, and 1706 were repealed, and new sections 1704 and 1705 were added in 1967 following legislative passage of Senate Bill 1310. (See Exhibit #1c) Senate Bill 1310, regarding filing of notices of appointment and termination of agents by insurance companies, was introduced on April 11, 1967 by Senator Albert Rodda at the request of the Department of Insurance. (See Exhibit #1a, #3, document A-14, and #4, document PE-1)
Senate Bill 1310 was assigned to the Senate Committee on Insurance and Financial Institutions and the Assembly Committee on Finance and Insurance where policy issues raised by the bill were considered. (See Exhibit #2) One amendment was made to Senate Bill 1310. (See Exhibits #1b and #2) Subsequent to legislative approval, Governor Ronald Reagan signed Senate Bill 1310 on August 3, 1967 and it was recorded by the Secretary of State on August 4th as Chapter 977 of the Statutes of 1967. A digest of Senate Bill 1310 as last amended was set forth as follows in the Office of Legislative Counsel’s Report on the Enrolled Bill:
Revises the provisions relating to the statement, made by an insurer, which is required to be filed by an applicant for a license to act as a life agent, life only agent, or disability only agent.
Specifically provides that license of an organization licensed as life agent is to become inoperative upon the happening of prescribed conditions and shall automatically terminate unless such license is reactivated within 30 days by the correction of all deficiencies.
Grants a natural person who is otherwise entitled in all respects to be licensed as a life agent but has never had an insurer appointment or has had the same terminated, or has never filed a statement of employment or has had the same terminated, the right upon request to be issued a certificate that a license of the same type will be issued upon the filing of such an appointment or such a statement.
