Several Public Resources Code sections were affected in 1955 following legislative passage of Assembly Bill 3402. (See Exhibits #1a through #1g) Assembly member Joseph C. Shell introduced this measure pertaining to oil, gas, and mineral leases of state lands, on January 21, 1955. (See Exhibit #1a)
Assembly Bill 3402 was assigned to the Assembly Committee on Manufacturing, Oil and Mining Industry and the Senate Committee on Local Government where policy issues raised by the bill were considered. (See Exhibit #2) The fiscal ramifications of the bill were considered by the Assembly Committee on Ways and Means and the Senate Committee on Finance. (See Exhibit #2) Six amendments were made to Assembly Bill 3402 during legislative consideration. (See Exhibits #1b through #1g and #2) Subsequent to legislative approval, Governor Goodwin G. Knight signed the bill on June 15, 1955, and it was recorded by the Secretary of State on July 6, 1955 as Chapter 1724 of the Statutes of 1955. (See Exhibits #1h and #2)
Neither of the committees hearing this bill nor its author have left documentation surviving upon its consideration. Given these circumstances, we found that the post-enrollment legislative bill file for the Governor regarding this legislation provided helpful documents. (See generally, Exhibit #6) Through the materials located in the Governor’s file we are able to gain some insight into the intent of the legislation. The information in these materials was presumably presented to the legislature by the writers who were participants in the legislative process. (Id.)
The Legislative Counsel analysis of Assembly Bill 3402 as last amended on June 6, 1955 summarized the bill as follows:
Amends and adds various secs., P.R.C., re oil, gas, and mineral leases of State lands.
Revises the provisions of Ch. 3, Pt. 2, Div. 6, re leasing of State lands for production of oil, gas, and other minerals, including financial return to the State therefrom, qualifications for leasing, assignment and transfer of leases, term of such leases, forfeiture, and other provisions regarding such leases.
Changes conditions under which State tide and submerged lands may be leased for production of oil and gas and required terms of such leases.
