ASSEMBLY BILL 1418 (LAIRD – 2003)

Business and Professions Code section 27 and Labor Code sections 1741 and 1775 were amended in 2003 with the enactment of Assembly Bill 1418.  (See Exhibit #1g)  Assembly member John Laird introduced this measure relating to labor violations on February 21, 2003, on behalf of the State Building and Construction Trades Council of California.  (See Exhibits #1a and #14, documents PE-2 and PE-31) 

Assembly Bill 1418 was assigned to the Assembly Committee on Labor and Employment and the Senate Committee on Labor and Industrial Relations where policy issues raised by the bill were considered.  (See Exhibits #3 and #8)  The fiscal ramifications of the bill were considered by the Assembly Committee on Appropriations and the Senate Committee on Appropriations.  (See Exhibits #2 and #4)  Five amendments were made to Assembly Bill 1418.  (See Exhibits #1b through #1f and #2)  Subsequent to legislative approval, Governor Gray Davis signed the bill on October 11, 2003, and it was recorded by the Secretary of State on October 12, 2003 as Chapter 849 of the Statutes of 2003.  (See Exhibits #1g and #2)

The Office of Senate Floor Analyses’ Third Reading analysis of Assembly Bill 1418, as last amended on August 27, 2003, summarized the measure as follows:

This bill establishes minimum penalties relating to violations of prevailing wage requirements, and requires the Contractors State License Board to make information regarding specified contractors available on its web site for willful violations of labor laws.
