As enacted, Assembly Bill 2428 amended section 89539 of the Education Code and amended sections 18671.2, 18676, 19582, 19586, and 19803 of the Government Code, relating to public employees. (See Exhibit #1e) Assembly member Gary Miller introduced the bill on February 21, 1996 at the request of the State Personnel Board. (See Exhibits #1a and #12, page 1)
Assembly Bill 2528 was assigned to the Assembly Committee on Judiciary and the Senate Committee on Public Employment and Retirement where policy issues raised by the bill were considered. (See Exhibits #3 and #8) The fiscal ramifications of the bill were considered by the Assembly Committee on Appropriations and the Senate Committee on Appropriations. (See Exhibits #5 and #10) Three amendments were made to Assembly Bill 2528. (See Exhibits #1b through #1d and #2) Subsequent to legislative approval, Governor Pete Wilson signed the bill on September 12, 1996, and it was recorded by the Secretary of State on September 13, 1996 as Chapter 472 of the Statutes of 1996. The Special Consent analysis prepared by the Office of Senate Floor Analyses provided the following digest of Assembly Bill 2528 as last amended on July 11, 1996:
DIGEST: This bill requires the California State University (CSU) and certain local agencies to reimburse the State Personnel Board (SPB) for costs incurred for conducting hearings involving their employees, and would replace the current “transactional immunity” protection with the narrower “use immunity” protection.
