ASSEMBLY BILL 324 (DIAZ – 2003)

Labor Code sections 1771.5 and 1771.7 were amended in 2003 with the passage of Assembly Bill 324, which affected these two sections only.  (See Exhibit #1c)  Assembly member Manny Diaz introduced this measure relating to labor compliance programs on February 7, 2003.  (See Exhibit #1a)  The State Building and Construction Trades Council of California sponsored the measure.  (See Exhibit #12, document A-8)

Assembly Bill 324 was assigned to the Assembly Committee on Labor and Employment and the Senate Committee on Labor and Industrial Relations where policy issues raised by the bill were considered.  (See Exhibits #3 and #7)  The fiscal ramifications of the bill were considered by the Assembly Committee on Appropriations and the Senate Committee on Appropriations.  (See Exhibits #2 and #4)  One amendment was made to Assembly Bill 324.  (See Exhibits #1b and #2)  Subsequent to legislative approval, Governor Gray Davis signed the bill on October 11, 2003, and it was recorded by the Secretary of State on October 12, 2003 as Chapter 834 of the Statutes of 2003.  (See Exhibits #1c and #2)

The Office of Senate Floor Analyses summarized Assembly Bill 324, as last amended on March 25, 2003, as follows:

This bill codifies state regulations requiring a labor compliance program on a public works project be approved by the Director of the Industrial Relations, and modifies the formula that provides reimbursement for increased costs associated with labor compliance programs pursuant to the School Bonds Acts.
