Business and Professions Code sections 12246, 17200, 17203, 17206, and 17536 were amended in 1992 following legislative passage of Senate Bill 1586. (See Exhibit #1e) Senator Robert Presley introduced Senate Bill 1586 on February 19, 1992 at the request of the California Retailers Association. (See Exhibit #1a and #3)
Senate Bill 1586 was assigned to the Senate Committee on Judiciary and the Assembly Committee on Judiciary's Subcommittee on the Administration of Justice where policy issues raised by the bill were considered. (See Exhibit #3 and #8) The Senate amended the bill on April 30 and May 13, 1992. (See Exhibit #1b, #1c, and #2) The Assembly amended the bill on June 25, 1992. (See Exhibit #1d) Subsequent to legislative approval, Governor Pete Wilson signed the bill on August 1, 1992, and it was recorded by the Secretary of State on August 3, 1992 as Chapter 430 of the Statutes of 1992. The Enrolled Bill Report of the Department of Consumer Affairs summarized Senate Bill 1586 as follows:
This bill would make various clarifying and interpretive changes to Business and Professions Code §§ 17200 et seq., dealing with unfair competition, and §§ 17500 et seq., dealing with false and misleading advertising.
