Former section 1747.8, the predecessor of current Civil Code section 1747.08, was added to the Civil Code in 1990 following legislative approval of Assembly Bill 2920, which affected this section only. (See Exhibit #1g) Assembly Bill 2920 was introduced by Assembly member Rusty Areias, among others, on February 14, 1990. (See Exhibits #1a and #1g)
Assembly Bill 2920 was assigned to the Assembly Committee on Finance and Insurance for consideration of the policy issues raised by the bill. (See Exhibit #3) After approval by that Committee, the Assembly Committee on Ways and Means examined the bill’s fiscal ramifications. (See Exhibit #5) The Assembly amended the bill on March 19, May 14, and May 29, 1990. (See Exhibits #1b through #1d and #2) Assembly Bill 2920 was approved by the Assembly and forwarded to the Senate on June 14, 1990. (See Exhibit #2)
While in the Senate, the Committee on Judiciary heard the policy issues presented by the bill. (See Exhibit #8) Subsequent to approval by that Committee, Assembly Bill 2920 was assigned to the Senate Committee on Appropriations which examined its fiscal implications. (See Exhibit #2) Two amendments were made to
Assembly Bill 2920 by the Senate, on June 27 and July 27, 1990. (See Exhibits #1e, #1f and #2) The Senate voted to pass the bill on August 16, 1990, and it was
returned to the Assembly on that date. (See Exhibit #2) The Assembly approved the Senate amendments and forwarded Assembly Bill 2920 to the Governor on August 29, 1990. (Id.) Governor George Deukmejian signed the bill on September 17, 1990, and the Secretary of State recorded it on September 18th as Chapter 999 of the Statutes of 1990. (See Exhibits #1g and #2)
A summary of Assembly Bill 2920 as last amended was provided in the Third Reading analysis prepared by the Office of Senate Floor Analyses as follows:
. . . This bill provides that retailers or others who accept credit cards as payment be prohibited from requesting a customer’s personal identification information as a condition of accepting the credit card payment.
