ASSEMBLY BILL 1381 (BAGLEY – 1968)

Numerous sections of the California Codes were affected by legislative passage of Assembly Bill 1381 in 1968.  (See Exhibit A, #1g)  This legislation was known as the “California Public Records Act.”  (Id.)  Assembly members William T. Bagley and Harvey Johnson introduced the bill on April 3, 1968 on behalf of the California Newspaper Publishers Association.  (See Exhibit A, #1a and #5, page 1) 


 


The Assembly and Senate Committees on Judiciary considered the policy issues raised by the measure.  (See Exhibit A, #3 and #5)  The Assembly Committee on Ways and Means and the Senate Committee on Finance examined the bill’s fiscal implications.  (See Exhibit A, #2)  Assembly Bill 1381 was amended five times, twice in the Assembly and three times in the Senate, before being approved by both Houses of the Legislature.  (See Exhibit A, #1b through #1f and #2)  Governor Ronald Reagan signed the legislation on August 29, 1968, and it was thereafter recorded as Chapter 1473 of the Statutes of 1968.  (See Exhibit A, #1g and #2)


 


A summary of Assembly Bill 1381 was noted in the Enrolled Bill Report to Governor prepared by the Legislative Secretary as follows:


 


Assembly Bill No. 1381 enacts the California Public Records Act.  The bill defines public records and requires public records to be open to inspection during office hours.
